UPDATE: It has been confirmed that, on the day that Brenden Day faces more serious charges involving public indecency, the Principal of Park Elementary, Dawn DeWald, has been placed on administrative leave.

DeWald faced a torrent of criticism for not warning parents concerning Day's alleged activities near the school.

The man accused of exposing himself to a Park Elementary School student last week was charged with one felony county of third-degree sexual abuse of a minor on Friday.

Brenden Day, 20, heard the single count against him during his initial appearance in Natrona County Circuit Court.

Judge Steven Brown set his bond at $15,000, and he was in custody as of Friday afternoon.

On Wednesday, prosecutors dismissed two misdemeanor counts -- public indecency and child endangerment -- that had been filed against him last week. He was then re-arrested and charged with the new count.

Day will have a preliminary hearing within several weeks to determine if his case will be bound over to district court for trial. The maximum sentence of third-degree sexual abuse of a minor is up to 15 years imprisonment.

The case began Monday, April 18, when the 9-year-old girl was walking home from Park Elementary when a man approached her near Milton and Beech streets, according to court records. He was shaking his penis at her. She ran home, and called her mother who notified police, according to court records.

The daughter was able to describe Day to police. A detective compared her description to six other reports of a man masturbating in local businesses, and found a description of the vehicle -- a green sport utility vehicle -- he was using.

Police located a vehicle matching that description, stopped it at Durbin and 11th streets. They saw Day, who appeared "visibly scared, sweating and shaking." He was "repentant and ashamed for his actions" during his police interview, according to court records.

The girl's mother, Amanda Huckabay, later learned police alerted the principal of Park Elementary School about a possible child predator downtown. The principal told Huckabay she didn't tell parents, students and teachers about the man because some parents were uncomfortable with the subject of pedophilia.

Earlier this week, Huckabay told the board of trustees of the Natrona County School District about her experience.

Other parents have come forward, saying they have known of and reported similar incidents to police since last summer.

Ogden said Friday that police have responded to all those reports, but were never able to locate suspects. He added there have been other men doing the same thing and it is not certain whether Day was the suspect.

Thursday, Natrona County School District spokesman Kelly Eastes said the district is reviewing its policies and protocols. It intends to conduct a community meeting next week about how to respond to incidents such as these. That date has not been set.
